I. General Terms and Conditions and Customer Information
1. Contractual basis
a) These General Terms and Conditions govern the contractual relationship between the
Chronofactum – Tancred Tescher Brands of Europe, Rosenheimer Str. 5, 83059 Kolbermoor, Telephone +49 (0)8031 2087 192, Email: Info(at)chronofactum.de (hereinafter referred to as "Seller")
and the customer in sales via the online shop https://www.chronofactum.de about the goods offered by the seller.
For the purposes of these provisions, customers are both consumers (any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor independent professional activity) and entrepreneurs (any natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity).
b) The General Terms and Conditions, in the version valid at the time of the conclusion of the contract, shall apply to all contracts for the supply of goods concluded exclusively using means of distance communication.
The customer's differing terms and conditions only apply if their inclusion has been expressly agreed upon. The mere fact that the seller performs the agreed service with knowledge of any customer terms and conditions does not constitute an agreement. This also applies if the seller has not expressly objected to the validity of the customer's terms and conditions upon delivery.
c) The contract language is German. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
2. Offer, conclusion of the contract, correction options, storage of the contract text
a) The product descriptions on the seller's online shop pages constitute non-binding offers to place an order.
After the customer has completed the order process, the purchase contract is concluded upon receipt of the customer's binding order by the seller through transmission of the contract confirmation (e.g. by telephone, fax, email or letter).
The initial automatic order confirmation does not constitute acceptance of the contract offer, but merely confirms receipt of the order. If the contract offer is not accepted within 5 days, it is considered rejected and the customer is no longer bound by it.
b) To submit a binding order via the seller's online shopping cart system, the customer places the selected item(s) in the virtual "shopping cart" by clicking the "Add to cart" button. The customer can remove the item(s) from the shopping cart at any time by clicking the corresponding button.Open the shopping cart icon in the upper right corner of the page and make changes. After adding the desired items to the shopping cart, the customer proceeds to the "next step" page by clicking the "next step" button. Following this, the customer selects the payment method and shipping option, which leads to the order summary page. Here, the customer can review all order details and make changes or adjustments (for example, by clicking the "edit" links or using the browser's "back" button) or cancel the order (e.g., by closing the browser window). The order process is only complete after clicking the "buy" button.
c) PayPal
If the customer chooses the payment method “PayPal”, the contract between the customer and the seller is concluded immediately upon clicking the “order with obligation to pay” button, in deviation from section 2.a).
At the end of the order process, the PayPal input form appears, where the customer enters their PayPal email address and password. Upon confirmation of payment by the customer, the purchase price, including any applicable shipping costs, for the products selected by the customer, is immediately credited to the seller's account. Shipping takes place one business day after payment is initiated, which is equivalent to receipt of payment.
d) Note on contract text storage
The seller does not store the customer's order data and the contract text in a form that is subsequently accessible to the customer. If the customer wishes to document their order details, they can copy, print or otherwise save them before submitting the binding order.
However, the seller will send the customer a contract confirmation, which contains the contract details, at the latest upon delivery of the goods.
3. Payment, Delivery
a) Unless otherwise agreed, delivery of ordered goods will only be made against prepayment (i.e. by bank transfer) to the address provided during the ordering process.
The only exception is for payments made via PayPal, where delivery is made to the address registered with PayPal at the time of payment.
Unless the customer and the seller have agreed otherwise, payment is due immediately after conclusion of the contract in the case of advance payment.
b) Delivery usually takes place within 2 weeks of the conclusion of the contract, unless a different delivery time is expressly stated in the item description or a different delivery time has been expressly agreed upon. Due to the current coronavirus crisis, delivery delays may occur.
